SUMMARY:Takes effect: Patient Protection and Affordable Care Act; Temporar
y Moratoria on Certain Agent and Broker Registration To Participate in th
 e Exchanges
DESCRIPTION:This interim final rule with comment period (IFC) codifies the
Department of Health and Human Services' (HHS) authority to impose a tem
porary moratorium pausing the registration of agents and brokers that do
not have a current Plan Year registration with the Federally- facilitated
Exchanges at the time the moratorium is effective and are seeking to ent
er into Exchange agreements with the Centers for Medicare & Medicaid Serv
ices (CMS) to assist consumers with enrollment through the Federally-faci
litated Exchange (FFE) and State-based Exchanges that use the Federal pla
tform (SBE-FPs) (hereinafter collectively referred to as the "Federally-f
acilitated Exchanges"). HHS is issuing this rule on an interim final basi
 s. For the reasons explained in this rule\, HHS finds good cause under th
e Administrative Procedure Act (APA) to waive prior notice and comment be
cause providing advance notice would be contrary to the public interest a
nd impracticable. HHS further finds good cause under the APA for this rul
e to become effective immediately upon publication. HHS nevertheless invi
tes public comment and will consider comments in determining whether to r
etain\, modify\, or rescind the codified authority established by this ru
le. Further\, CMS provides notice that\, on behalf of HHS\, the agency is
immediately imposing a temporary moratorium to pause the registration of
agents and brokers that do not have Plan Year 2026 Exchange agreements w
ith the Federally- facilitated Exchanges and are seeking to enter into ag
reements with CMS to assist consumers with enrollment through the Federal
ly-facilitated Exchanges for Plan Year 2027. This temporary moratorium do
es not affect registrations on the State-based Exchanges (SBEs). This mor
atorium will be in place while CMS implements enhanced program-integrity
safeguards designed to prevent instances of noncompliance and fraud\, was
te\, and abuse perpetrated by agents and brokers\, including unauthorized
enrollment activity\, misuse of consumer personally identifiable informa
tion (PII)\, and other conduct that does not comply with Exchange standar
ds and threatens consumers and the integrity of the Federally- facilitate
d Exchanges. Agents and brokers that do not have Plan Year 2026 Exchange
agreements with CMS will not be able to complete registration with the Fe
derally-facilitated Exchanges for Plan Year 2027 until the moratorium end
 s on February 1\, 2027.\nRecord: https://civibrief.com/actions/frl-2026-1

DESCRIPTION:As required by the Privacy Act of 1974\, notice is hereby give

SUMMARY:Comments close: Improving Patient Access to Deceased Donor Islet C
ells and Cell Products; Request for Information
DESCRIPTION:The Department of Health and Human Services (HHS) is opening a
public docket to solicit input\, supporting data\, and comments to assis
t HHS as it considers how best to regulate deceased donor islet cells and
/or deceased donor islet cell products for the treatment of Type 1 diabet
es (T1D). The purpose of this information is to allow HHS agencies to bet
ter understand how best to regulate these therapies\, including whether a
nd how regulation could differ between isolated and otherwise unmodified
deceased donor islet cells and deceased donor islet cell products. In thi
s request for information\, HHS will specify the type where appropriate o
r will refer to both types under the umbrella term of islet therapies. HH
S seeks information on whether sufficient publicly available information
exists to establish standards for how to transplant deceased donor islet
cells and/or develop deceased donor islet cell products\, as well as whet
her other publicly available data exist to support their safe and effecti
ve use. Additionally\, HHS seeks input on the possibility of defining unm
odified deceased donor islet cells as organs\, which would allow the proc
urement\, allocation\, and transplantation of these cells to be performed
in accordance with applicable Organ Procurement and Transplantation Netw
ork (OPTN) policy and regulated by HRSA. Doing so would require OPTN esta
blishing appropriate standards for safety\, effectiveness\, quality and c
onsistency of islet cell processing and isolation\, and surveillance and
policies regarding the training and experience of transplant surgeons and
transplant physicians in designated pancreatic islet cell transplant pro
 grams.\nComment: http://www.regulations.gov/commenton/FDA-2026-N-10738-00

Health Benefits (FEHB) Program\, which includes the Postal Service Health

SUMMARY:Takes effect: Transparency in Coverage
DESCRIPTION:These final rules set forth requirements that amend the regula
tions under the Public Health Service Act\, the Employee Retirement Incom
e Security Act of 1974\, and the Internal Revenue Code regarding price tr
ansparency reporting requirements for non- grandfathered group health pla
ns and health insurance issuers offering non-grandfathered group and indi
vidual health insurance coverage. Specifically\, these final rules are in
tended to improve the standardization\, accuracy\, and accessibility of p
ublic pricing disclosures in line with the goals of Executive Order 14221
\, "Making America Healthy Again by Empowering Patients With Clear\, Accu
rate\, and Actionable Healthcare Pricing Information." With respect to th
e In- network Rate and out-of-network Allowed Amount machine-readable fil
es\, these final rules aim to achieve these goals by adding new contextua
l files and additional data elements like product type\, provider network
name\, and provider network identifier; changing the reporting level for
aggregation of data; removing in-network rates for unlikely provider- to
-service mappings; increasing the reporting period and lowering the claim
s threshold for out-of-network historical data; and reducing the reportin
g cadence. These final rules also aim to improve the findability of all p
ublicly disclosed machine-readable files required under the Transparency
in Coverage rules\, including the prescription drug file\, by requiring a
text file containing contact information for the files\, and a footer wi
th website URLs. These final rules also require pricing information that
is made available through an online consumer tool and on paper (upon requ
est)\, to also be made available by phone\, and establish that the satisf
action of such requirement also satisfies the requirements of section 114
of the No Surprises Act (including for grandfathered group health plans
and health insurance issuers offering grandfathered group and individual
health insurance coverage that are not otherwise subject to these final r
 ules).\nRecord: https://civibrief.com/actions/frl-2026-20447
