When an agency comes to serve the industry it regulates rather than the public, through information, staffing, and sustained attention from the regulated side.

Capture is usually structural rather than corrupt. The regulated industry has more expertise, appears at every proceeding, and can afford sustained advocacy, while the diffuse public affected by the same rule rarely shows up. Disclosure, comment periods, and revolving-door restrictions are the standard countermeasures, and none of them are complete answers.
