burden of proof

Who must convince the factfinder, and how thoroughly. The party carrying it loses if the evidence is evenly balanced.

In full

Burden of proof combines two ideas: which side must produce evidence, and how convincing it must be. Allocation matters enormously. In a criminal case the government carries it throughout and the defendant need prove nothing, which is the practical meaning of the presumption of innocence.
